Legal Basis for Processing
If, when recording data, we are able to identify the person of the website visitor, this will constitute processing of personal data. We must have a legal basis for such processing.
In the case of necessary cookies, the legal basis will be the legitimate interests of the controller under Art. 6(1)(f) GDPR, who has an interest in ensuring the operation of the controller’s website. At the same time, such an approach is also permitted by Section 109(8) of Act No. 452/2021 Z. z. on Electronic Communications, under which: “Any person who stores or gains access to information stored in a user’s terminal equipment is only authorized to do so if the user concerned has given demonstrable consent. This does not prevent the technical storage of data or access to it, the sole purpose of which is the transmission or facilitation of the transmission of a message over a network, or where it is strictly necessary for an information society service provider to provide a service explicitly requested by the user.“

Automated Decision-Making and Profiling
